Rental Agreement - Haven Heights (Whole Property: Main house + Carriage OR Main house only)
This Rental Agreement is made and effective on the booking date between the Owner and Guest(s) regarding the property known as Haven Heights, which is located in Cape San Blas, Florida. This Renter Agreement is valid for online bookings through this website and for bookings directly made with and paid to the owner.
PAYMENT TERMS:

A 50% payment is due at the time of booking.

Full payment is due 90 days before arrival. If booked within 90 days of arrival, full payment is due at booking.

Payments are accepted via credit card or check (with prior approval).

Guest authorizes Owner to charge the credit card on file per this Agreement.
SECURITY DEPOSIT:
Whole Property (Main House + The Carriage House): $2,000 security deposit.
or
Main House only: $1,500 security deposit.
The security deposit will be placed as a hold on the Guest’s card 7 days prior to arrival and released 7 days after departure, provided no damage or policy violations occur. The deposit may be used for:

Damage to property or furnishings

Missing or misused items
-
Excessive cleaning
-
Unauthorized pool tampering or draining

Service calls due to Guest actions
-
Owner is not obligated to choose the least expensive means of restoration
Chargebacks or disputes via credit card companies for damages or reservation charges are waived by the signer and/or card holder.
CANCELLATION & REFUND POLICY:

Cancellations made 120+ days before arrival are eligible for a refund, less a 3% credit card fee and $150 administrative fee.

No refunds for cancellations within 120 days of arrival.

No refunds for early departure, delayed arrival, or no-shows.

All cancellations must be in writing (email accepted).

Guests are strongly encouraged to obtain Cancel For Any Reason Travel Insurance.
RENTAL POLICIES:

Rules & Regulations: Guest and their party must abide by all rules set forth in this Agreement, in the guidebook, and posted at the property.

Pet Policy: No pets are allowed on or inside the property. Unauthorized pets will result in immediate eviction, forfeiture of remaining stay, and a $2,000 fine. We comply with ADA regulations for service animals. Emotional support animals are not covered by the ADA. Misrepresenting a service animal is a breach of contract and subject to full penalties. Guests are encouraged to communicate service animal needs prior to booking to ensure alignment with this policy.

No Smoking Policy: Smoking, vaping, or the use of tobacco or marijuana is strictly prohibited anywhere on the property—including indoor spaces, porches, decks, and balconies. Violation of this policy will result in a minimum $2,000 charge and any additional costs for remediation, including lost rental income due to downtime. This is a zero-tolerance policy and may result in immediate termination of the rental. Please ensure everyone in your group is aware of this rule before booking.

Cleaning Policy: A standard cleaning fee covers professional deep cleaning after your departure. If the home is left excessively dirty with excess trash, food, spills, stains, or unwashed dishes, or if the cleaners are delayed due to the state of the property, additional cleaning fees will be charged. In addition, use of hard-to-clean materials such as hair dye, self-tanner, glitter or confetti is not permitted. Additional fees start at $250 and are at the sole discretion of the Owner based on the condition of the home.

Pool Use: Pool service is serviced twice weekly (Sun/Wed). All swimming is at the Guest’s own risk; no lifeguard is on duty. Guests are prohibited from tampering with any pool equipment. Foreign substances, including but not limited to glass, food, excessive sand, or oils, as well as misuse of the pool, may result in additional service charges. Children who are not potty-trained must wear swim diapers while in the pool. If the pool requires draining and refilling due to contamination, including broken glass, bodily fluids, food, or excessive sand, the Guest will be responsible for a restoration fee. Optional pool heating is available for $500 per week plus tax, and must be requested in advance.

Elevator Use: The elevator is provided at no additional cost and may be used throughout your stay. Please be aware that due to the extremely sensitive nature of residential elevators, this amenity can breakdown. If you incur any issues during your stay, this will be addressed as soon as possible. Our remote beach location may cause service delays and this amenity cannot be considered a guarantee. Children under 12 years of age must be accompanied by an adult to utilize the elevator. Tampering or troubleshooting the elevator without the guidance of owner may result in fines starting at $500. No refunds will be given for inconveniences caused by temporary elevator unavailability or repair delays. Children under 12 must be accompanied by an adult. Tampering with or attempting to troubleshoot the elevator without permission may result in a fine starting at $500.

Security Cameras: Exterior cameras monitor entry points 24/7. Tampering, disabling, or covering them is prohibited and will result in cancellation of your stay without refund.

Parking: Ample on-site parking is available, including a large main driveway and an additional parking pad at the front of the home-sufficient space for multiple vehicles and a boat, if needed. If only the Main House is being rented, parking adjacent to The Carriage House must be reserved exclusively for The Carriage House guests only. Clear signage is provided on-site, and additional instructions are outlined in the guestbook. Street parking is not permitted at any time.

Quiet Hours: Quiet hours are from 10:00 PM to 8:00 AM. Please respect neighbors and maintain reasonable noise levels at all times. Repeated violations may result in termination of stay without refund.

Check-Out Policy: Check-out is by 10:00 AM. Late checkouts past 10:15 AM will incur a $150 fee, plus $100 for every additional 30 minutes.

Owner’s Right to Enter: Owner may enter the property for inspections, maintenance, or emergencies. Owner or representative reserves the right to enter the property without prior notice. For showings (if property is listed for sale), 48-hour notice will be given.

Occupancy Limits: Guest occupancy must match the reservation. Day guests not included in the reservation are not permitted without prior written approval from the Owner. No subleasing. No unapproved group events. Violation may result in immediate eviction and forfeiture of all payments.

Furniture Policy: Furniture may not be moved from room to room or taken outside. All furnishings must be used only for their intended purpose. Do not drag furniture across the floors or sit on furniture in wet bathing suits.

Damage Reporting: Guests must report any property issues immediately upon arrival and during the stay. Unreported damage will be presumed to have occurred during your stay and my result in full or partial forfeiture of the security deposit.

Leave No Trace Ordinance: Compliance with Gulf County’s beach ordinance is required in order to protect our shoreline, provide a healthy habitat for nesting sea turtles, preserve our pristine environment and ensure all residents and visitors can enjoy our wonderful beaches. Ordinance states: a) all unattended personal items must be removed daily from the beach, b) all holes must be filled, c) no overnight camping within 400 feet of any residence, d) no glass on beach, e) bonfires must not be within 100 feet of any structure and remnants must be removed same day, f) all trash removed, g) no soliciting or canvassing, h) unlawful to remove sand from beach, i) pets must be on leash, j) beach driving only with permit from Gulf Co Tax Collectors office.

​DUAL RENTAL ARRANGEMENT NOTICE: Please be aware that Haven Heights is composed of two separate units: The Main House and The Carriage House. These may be rented together or independently.
If only the Main House is reserved, the Carriage House may be rented to other guests during your stay. In this event:

Main House guests will no have access to the Carriage House interior, private entrance, garage-level storage/amenities, or the designated Carriage House parking pad.

Carriage House guests will not have access to the pool, fenced-in areas, or interior of the Main House.

Both sets of guests will share use of the outdoor beach rinse-off area.

TERMINATION & LIABILITY:

Owner may terminate the Agreement upon any Guest violation without refund.

In case the property becomes unavailable, Guest's sole remedy is a full refund of payments made. No other damages will be due.

Owner is not liable for noise, power outages, water shortages, weather, or Acts of God.
-
Mechanical issues will be addressed as quickly as possible but are not grounds for cancellation or refund.
INDEMNIFICATION & ASSUMPTION OF RISK:
Guest accepts full responsibility for personal injury, illness, property damage, or loss occurring during their stay. This includes use of the pool, elevator, stairs, balconies, and interaction with wildlife.
Guest releases and agrees to indemnify Owner, agents, and contractors from all claims and liability, including injury, death, damage or losses related to their stay.
This waiver also applies to all persons allowed on the property by Guest.
LEGAL TERMS:

This Agreement is governed by the laws of Florida.

All disputes must be resolved within the State of Florida.
-
If any provision is unenforceable, the remainder remains valid.
-
Digital signature of this agreement constitutes full acceptance of its terms.
-
This document is the complete and binding Agreement.
FINAL AGREEMENT:

Reservation is contingent upon return of signed Rental Agreement and copy of government-issued ID.
-
If not received within 24 hours of booking, reservation may be canceled.

By submitting the 50% deposit, you agree to all terms of this Agreement.
